Writing a will
To ensure security and peace of mind for family members, Waters Lawyer’s provide clients with a simple and cost effective means to create a legal will.
Without a will, conflicts may arise within a family over the deceased’s estate and wishes. We can give you the legal advice and means to create a comprehensive and clear will in order to prevent any further upset to your family when dealing with this difficult time.
Challenging wills
A will can be challenged providing it is within six months of the date the Grant of Probate is issued. Wills can be challenged on the basis of if you have not been adequately provided for or left out of the will, you believe the Testator (person who the will is applied to) was not in an appropriate state of mind when the will was created, you believe the will is unfair and not to the wishes of the testator or the will in general is unclear.
Administering Estates
In order to administer the estate of a deceased person, a grant of probate may be required from the Supreme Court which allows the executor who is appointed to the will to distribute the assets and liabilities of the estate.
Legal advice and services provided by Waters Lawyers will help you evaluate whether or not applying for a grant is necessary and will also assist you when somebody dies that does not have a legal will in place. Without sufficient legal support on your side you may encounter difficulties when administration takes place.
